Both parties agree to the following terms and conditions: 

1. The Consignee agrees to leave the item(s) with the Consignor for a minimum of 90 days or pay a listing fee of $100 for each item retrieved before those 90 days.

2. The contract is effective as of and ceases to be effective after the item(s) have been retrieved by the consignee, or if the item(s) has been sold.

3. The Consignor is responsible for the promotion, marketing and customer service associated with selling your items including authentication, market price evaluation, photography, detailed product description, online listing, and shipping of your property upon receipt.The Consignor will take all necessary steps to sell the Consignee’s item(s) quickly for the best price possible. In addition to the Consignor’s in-house authentication, they may use a 3rd party authenticator to ensure items are authentic. The authentication process can take 1-2 business days. If the Consignee’s item(s) come back as not authentic, there will be a $250 fee to return the item or the item will be destroyed. 

4. The Consignee is entitled to retain the purchase price of sold items, less the commission (Table A). 

5. The Consignor will issue consignment payments via E-transfer or Bank transfer within 7 business days once the item has been sold, unless otherwise agreed upon between both parties. 

6. The Consignee agrees to obtain the price set from the consignor for each item sold (subject to evaluation of the item’s condition) and will accept nothing less than the agreed upon set price for the consigned merchandise unless otherwise agreed upon by both parties. The Consignee agrees to allow the Consignor to determine the condition of the item(s) based on the Consignor’s evaluation.  

7. If the Consignee is unable to drop off or pick up the item(s) to the Consignor’s designated location, the Consignee agrees to pay for all shipping costs associated with the drop off or return of their item(s). However, the Consignee is not responsible for any costs incurred for delivery of the item(s) to the purchaser of their item(s). 

8. The Consignee agrees to allow the Consignor to display mutually agreed upon item(s) online and store the item(s) in the area that is in the Consignor’s place of business. 

9. If an item is damaged, stolen, or lost while in the Consignor’s possession, they will pay the Consignee a commission on that item (Table A). The commission will be based on the damaged, stolen, or lost item’s estimated net selling price, which will be determined solely by the Consignor.  

10. The Consignee acknowledges and understands that the Consignor is subject to laws and regulations relating to claims that consigned items are counterfeit, have been stolen, or otherwise violate applicate law. The Consignor takes such reports seriously and will cooperate with law enforcement and all investigations.  

11. The Consignee confirms that the consigned merchandise is not stolen property or otherwise the proceeds of crime. 

12. The Consignee confirms that the consigned merchandise is not a counterfeit or imitation product, and does not violate any trademark, copyright, or patent law and pay $250 per item to retrieve those counterfeit or imitation product(s).
